Back pay to ex employees of city council
Released: 11 January 2008
Wolverhampton City Council has confirmed (Cabinet, January 9th) that all legitimate claims for back pay lodged as formal grievances by former employees within nine months of them leaving the Authority will be honoured.
Claims raised by ex employees submitted outside of that timescale will not be considered.
The recent exercise to settle potential equal pay claims and introduce a new pay and grading scheme under Single Status has involved the identification of existing employees who may have an equal pay claim.
Because Equal Pay legislation allows for the submission of claims for up to nine months after employment ends, there are likely to be ex-employees who could still lodge equal pay claims.
Back pay is being offered to current or ex employees only where there is a possibility of a discrimination claim existing.
The process for ex employees involves the submission of an equal pay claim to an Industrial Tribunal within six months of them leaving employment or the submission of a statutory grievance to the employer, which extends the period of consideration from six to nine months.
Where the recognised trade unions have been approached, they have advised ex employees to submit claims via the statutory grievance process.
The city council currently has some 214 registered enquiries about this matter.
