How we investigate a noise complaint
To investigate a complaint about noise an Officer from the council will almost always need to witness the noise first hand.
It is therefore important that you are as accurate as possible with the information you provide including:
- The address where the noise is coming from
- The times of day the noise generally occurs
- How often during the day the noise occurs
If you contact us when the noise occurs an Officer will attempt to get to your house in time to witness the alleged noise nuisance.
Surveillance and Monitoring
If the Officers are not available at the time but you can provide details of the times when the noise occurs then Officers may be able to undertake surveillance in an attempt to witness the alleged noise nuisance.
In certain cases Officers can install noise monitoring equipment to record the levels of noise. This equipment whilst useful is not necessarily better than the Officer witnessing the noise first hand since recordings may not indicate the source of the noise.
Legal Action
If the noise amounts to a statutory nuisance the Council can serve a legal notice on the person responsible for causing the noise nuisance requiring the abatement of the noise nuisance and preventing the nuisance from occurring again in the future.
If this legal notice is breached the responsible person could be at risk of prosecution.
Sometimes these cases can take a long time to resolve especially where the matter is taken to Court. We would ask that you remain patient and continue to assist us in the collection of the evidence we require for a successful case.
